Eligibility Criteria And Tenancy Agreement Conditions When Renting An NEA-Managed Hawker Stall

Singapore’s hawker culture is an integral part of our national identity and heritage. For over fifty years, hawker centres like Newton Food Centre, Old Airport Road Food Centre, and Chomp Chomp Food Centre served Singaporeans delicious and affordable food. Today, there are over 120 hawker centres across the island, with more on the way. In Singapore, hawker centres and hawker stalls are managed by the National Environment Agency (NEA), who have set out strict eligibility criteria and tenancy agreement conditions.

Here’s what you need to know about your eligibility when renting a hawker stall in an NEA-managed hawker centre.

Eligibility Criteria When Tendering For A Hawker Stall

To be eligible to tender for a cooked food hawker stall, you must be a Singapore Citizen or Permanent Resident, and you must be 21 years old and above and possess a valid Food Safety Course certificate. You must not already be renting or a joint operator of two cooked food stalls managed by NEA. The maximum number of cooked food stalls any individual can rent is 2.

Additionally, you must not be debarred from holding a Singapore Food Agency (SFA) hawker license, a former assistant or nominee who was deregistered by NEA, banned by the Government and Statutory Boards from taking part in any business tenders, or an undischarged bankrupt.

Eligibity Criteria For Joint Operators

Stallholders can include one joint operator on their tender. Joint operators have the same eligibility criteria as stallholders.

Stallholders and joint operators must not overlap operating hours, and it is the stallholder’s responsibility to ensure that rental and other fees are fully paid.

Eligibility Criteria For Hawker Assistants

To be eligible to help at a hawker stall, you must be a Singapore Citizen, Permanent Resident or a Long-Term Visit Pass (LTVP/LTVP+) holder with a pre-approved letter of consent (PLOC) or letter of consent (LOC). This allows spouses and unmarried children of citizens and PRs to work while still on a Long-Term Visit Pass.

Hawker assistants must be 13 years old and above and must possess a valid Food Safety Course certificate. They must not be an existing subsidised stallholder, existing stall nominee, or debarred or blacklisted from operating a hawker stall by NEA.

Types Of Cooked Food Stalls

There are 5 broad trade categories of cooked food at NEA-managed hawker centres. Do take note of the tender notice to see if there are any restrictions for the stall you plan to bid for. These are:

#1 Cooked Food

The sale of any type of cooked food, including hot and cold desserts.

#2 Cooked Food (Halal)

The sale of any halal cooked food. Non-Muslim stallholders must obtain a Halal certification from MUIS for the sale of halal food. The sale of non-halal food is not allowed.

#3 Cooked Food (Indian Cuisine)

The sale of any Indian cuisine including, but not restricted to, vadai, thosai, roti prata, nasi briyani, putu mayam, masala and tandoori chicken.

#4 Cut Fruits

The sale of all types of cut fruits. The sale of jelly, sugarcane juice and blended fruit juices are allowed. Bottled and pre-prepared drinks are not allowed.

#5 Drinks

The sale of hot and cold drinks, including packaged, bottled or dispenser drinks, small food items like cakes and buns, or sale of other cold drinks such as soya bean and grass jelly drinks, sugarcane juice. You are not allowed to sell alcohol alone at drinks stalls.

Terms & Conditions To Look Out For In The Tender

Before you submit your tender, you have to declare that you have read, understood and accepted all the Terms and Conditions of Tender for NEA-managed Hawker Centres

Here are some clauses you may wish to look out for:

Clause 14: All tenderers shall be deemed to have full notice and knowledge of the actual area and state of the stall.

Each tender notice clearly states the stall number and the approximate stall area in square meters. Potential stallholders should visit the desired vacant stall, not just to confirm the size, but also to take note of human traffic as well as potential competitors nearby.

Clause 30: The Agreement with any successful tenderer for a cooked food stall or market stall shall be for a period of thirty-six (36) months.

The winning bid you made for tendered rent is only valid for the first three years. Subsequently, the renewal of the Agreement is at NEA’s discretion, and your rental may also change to bring it closer to the median Assessed Market Rate (AMR) for the hawker centre.

This means that if your tendered rent is higher than the AMR, your rent may be reduced at the next tenancy renewal. If it is lower than the AMR, it may increase at the next tenancy renewal.

Rental will now be staggered over a longer period. This change, which took effect in November 2024, was implemented to deter high bids for hawker stalls. These high bidders were counting on their rent being significantly reduced after the first three years.

Clause 32: The successful tenderer shall within three (3) months from the commencement date of the Agreement of the stall, commence business at the stall.

Timing is everything in business, especially when it comes to owning a hawker stall. If you are not prepared to start your hawker business within 3 months, it may be best not to tender for the stall, no matter how prime the location is. This also means that any alterations and additions to the stall need to be done within 3 months, so do take that into consideration as well.

Clause 35: Successful tenderers must operate the stall personally with or without assistants. They can also include a joint operator duly registered with the NEA. The successful tenderer and the joint operator are each required to personally operate the stall for at least four (4) hours per business day.

This clause recently made the news when a social media post questioning the definition of “personally operate” went viral. Hawker Noorman Mubarak said he had received an NEA warning for violating the tenancy agreement because his wife, as the registered stallholder, was not physically at the stall for at least 4 hours each day.

In response, the NEA-appointed operator reportedly suggested that the stallholder appoint a stall nominee to operate the stall on their behalf. A stall nominee may be appointed under specific circumstances, including illness, national service, reservist, overseas travel, advanced pregnancy and post-natal confinement, old age or disability.

In most cases, the stall nominee must be a member of the stallholder’s immediate family and the application process can take 4 to 6 weeks to complete.

Clause 36: All stallholders are not allowed to sublet and assign their stalls.

Despite the practice reportedly being an “open secret”, subletting an NEA-managed hawker stall is illegal. These hawker stalls are subsidised and should not be used for personal gain.
