Yet, payroll miscalculations can happen, even to well-resourced companies. For instance, the Civil Service previously reported payroll miscalculations affecting around\u00a0<a href=\"https:\/\/www.straitstimes.com\/singapore\/3000-civil-servants-to-get-10m-in-compensation-after-errors-in-records-affected-their\" target=\"_blank\" rel=\"noreferrer noopener\">3,000 past and present employees<\/a>.\u00a0<\/p>\n\n\n\n<p>Payroll miscalculations can occur both ways: underpayment and overpayment. Under the&nbsp;<a href=\"https:\/\/dollarsandsense.sg\/business\/singapore-employment-act-statutory-requirements-pay-employees\/\">Employment Act<\/a>, an employer is legally obligated to pay the employees their salary in full, on time. Employers are legally allowed to deduct any salary overpayment from employees\u2019 salaries.&nbsp;<\/p>\n\n\n\n<p>If the salary overpayment happened while the employee is still under the employment of the company, it is straightforward to recover the overpayment through salary deduction.\u00a0<\/p>\n\n\n\n<p>Unlike other salary deductions that are usually capped at&nbsp;<a href=\"https:\/\/www.mom.gov.sg\/employment-practices\/salary\/salary-deductions\">25% of an employee\u2019s salaries<\/a>, employers can deduct salary overpayments in full. Deductions for salary overpayment are also not subject to the 50% max deduction per salary period. Typically, salary deductions are capped at 25% to a maximum of 50% to allow employees sufficient leeway in meeting their monthly recurring expenses. If the employee has spent the overpayment and the overpayment has been incremental over a long period of time, recovering the full amount through salary deductions spanning one or more months can be detrimental to their day-to-day finances.\u00a0<\/p>\n\n\n\n<p>In such cases, it may be better for the employer and employee to work out a repayment plan and gradually recover the overpayment across multiple salary periods. However, it is much more difficult to do so as you cannot deduct from their salaries. Assuming that you can contact your former employee, you can request that they repay you the overpayment and inform that they are legally bound to comply.&nbsp;<\/p>\n\n\n\n<p>However, if they refuse to repay you or they are uncontactable, you may have to seek legal action, especially if the overpayment is substantial, such as in the case of&nbsp;<a href=\"https:\/\/www.straitstimes.com\/singapore\/courts-crime\/ex-ttsh-employee-admits-to-withdrawing-salary-mistakenly-credited-to-her\">Tan Tock Seng Hospital<\/a>&nbsp;which continued paying an ex-employee for over a year after her employment ceased and the overpayment amounted to over $32,000.&nbsp;<\/p>\n\n\n\n<p>If the overpayment is within the company\u2019s means, it may be worth considering writing it off, instead of pursuing legal action. This is especially so if the overpayment happened years ago and certain employees may have actually retired. In the case of&nbsp;<a href=\"https:\/\/www.straitstimes.com\/singapore\/3000-civil-servants-to-get-10m-in-compensation-after-errors-in-records-affected-their\">Civil Service\u2019s payroll miscalculations<\/a>, the errors in payment date back to the&nbsp;1990s about 30 years ago. While the Public Service Division rectified the errors by making good payments for the underpaid employees, they chose not to pursue the cases of overpayment.<\/p>\n\n\n\n<h3 id=\"accurate-payroll-is-essential\"><strong>Accurate Payroll Is Essential<\/strong><\/h3>\n\n\n\n<p>Regardless, salaries can affect the lives of employees, past and present. In cases of overpayment, employers should exercise sensitivity in making salary deductions and make clear explanations to their employees before deducting their salaries. Likewise, for employees who have left the company, the employer needs to weigh whether it is worth the while to pursue the salary overpayment recovery.\u00a0<\/p>\n\n\n\n<p>As an employer, it is only good practice (and mandatory under the\u00a0<a href=\"https:\/\/dollarsandsense.sg\/business\/singapore-employment-act-statutory-requirements-pay-employees\/\">Employment Act<\/a>) to maintain accurate itemised payslip records.
